Terms & Policies Agreement Please read our Terms & Policies with care before proceeding with the use of the App’s services, content, technologies or applications. By using our service or by clicking to agree with these terms when prompted, means that you are hereby bound to these terms and must now abide by them. In addition, please read our Privacy Policy for more important details. All our content shall be made accessible to each & every member of the public for free unless stated otherwise. Terms of Service: Payment and Rewards By using the Service as defined below, you agree that you have read, understood, accepted and agreed with the Terms of Use. You further agree to the representations made by yourself below. If you do not agree to or fall within the Terms of Use of the Service and wish to discontinue using the Service, please do not continue using the Application (as defined below) or the Service. The Terms of Use stated herein (collectively, the “Terms of Use” or this “Agreement”) constitute a legal agreement between you and the Company. 1. Use of the the App i. Type of transaction that can be made with the App: The App may be used for the sale and purchase of goods and services from businesses integrated by the company and all merchants lawfully offering the App as an accepted rewarding solution (either by way of static/dynamic QR Code payment, settlement via the Application, or online settlement), PROVIDED HOWEVER that no payments in violation of the provisions of these Terms & Conditions, including the Acceptable Use Policy shall be permitted. ii. Applicable Fees and Charges: There shall be no charges levied by the App on usage of the App by consumer. The App shall charge merchants or agents for usage of the application. iii. Fraudulent activity or stolen Reward Points: You agree to immediately notify the customer service team of any fraudulent activity or theft of funds in the App of which you become aware. The gift redemption campaign (hereinafter referred to as the “Campaign”) is open to members only residing in Malaysia and is above 18 years of age (“Eligible Participants”). b. Campaign will commence from 30th December 2020 to 31st December 2021. c. The company reserves the right to disqualify any person that it knows is, or has reasonable grounds to believe is, ineligible for this Campaign as a result of the terms and conditions (“Terms and Conditions”) herein. d. No registration is required and Eligible Members shall be automatically registered for participation in the Campaign upon usage of their reward points and in accordance with these Terms & Conditions. e. The tracking of transactions is based on the transaction dates and/or time (Malaysian Time) as captured by our system records during the Campaign Period. We shall not be responsible for any delay and/or failure in the transmission of evidence of sales transactions by merchants or any other party. f. All transactions as recorded in the Campaign period shall be final and conclusive. The determination as to what constitutes Eligible redemption transactions is conclusive and cannot be challenged in any manner whatsoever. (B) Prizes a. The quantity and type for redemption of all the prizes will change from time to time without prior notice. b. In the event of unavailability of the Prize or any of its component(s) or a change of circumstances, the company reserves the right to substitute the Prize or any of its components thereof with any other item of similar value at any time without prior notice. c. The company reserves the right at its absolute discretion to vary, delete or add to any of these Terms and Conditions without prior notice or to cancel, terminate or suspend this Campaign at any time without notice or liability. d. These Terms and Conditions shall prevail over any provisions or representations contained in any other promotional material or advertising of this Campaign. e. All decisions made by the company on all matters relating to this Campaign are final and binding and no correspondence will be entertained. f. For the avoidance of doubt, cancellation, termination or suspension by the company of this Campaign shall not entitle any Member to any claim or compensation against the company for any and all losses or damages suffered or incurred by the Member or the prize Winner as a direct or indirect result of such act of cancellation, termination or suspension. g. The company will not assume any liability in case of any injury, damage or claim resulting from taking part in the Campaign and/or use and/or redemption of their prizes. h. In no event will the company be liable for any loss or damages including without limitations, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third [The Terms & Policies Version 2020.12.24] parties howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Campaign even if the company have been advised of the possibility of such damages in advance, and all such damages are expressly excluded to the furthest extent permitted by law. Failure to provide consent will render the Member’s entry disqualified. 3. Intellectual Property Ownership ? The Company and its affiliates, where applicable, shall own all right, title and interest, including all related intellectual property rights, in and to the Software and/or the Application and by extension, the Service and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to the Service. ? The Company does not represent or warrant that: o The use of the Service, the Application and/or the Software will be secure, timely, uninterrupted or error-free or operate in combination with any other hardware, software, system or data; o The Service and/or Rewards will meet your requirements or expectations; o Any stored data will be accurate or reliable; o The quality of any products, services, information, rewards or another material purchased or obtained by you through the Application will meet your requirements or expectations; o Errors or defects in the Application and/or the Software will be corrected; or o The Application or the Server that make the application available are free of viruses or other harmful components. ? The Service, the Application and/or the Software may be subject to limitations, delays and other problems inherent in the use the internet and electronic communications including the device used by you or other THE App Users being faulty, not connected, out of range of mobile signals or functioning incorrectly.
